Terms of Use

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our Services as an organizer. Participants who upload photos via QR codes must have permission from the organizer.

2. Description of Services

• Generate QR codes that allow participants (“Users” or “Participants”) to upload photos or files.
• Route uploads securely into Organizer-designated cloud storage (Google Drive, Microsoft OneDrive, SharePoint).
• Manage photo submissions without requiring Participants to create TeamDayQR accounts.

3. Accounts and Responsibilities

• Organizers: Must create an account and link cloud storage. You are responsible for folder setup, permissions, and compliance with your organization’s policies.
• Participants: Do not need an account. By uploading, Participants grant the Organizer rights to use the content as per the Organizer’s terms.
• Your Responsibility: You are responsible for all activity under your account and for informing Participants of how their uploads will be used.

4. Content Ownership and Rights

• Participants’ Content: Participants retain ownership of uploaded photos/files.
• License to Organizers: Participants grant Organizers a non-exclusive, worldwide, royalty-free license to use, store, display, and share the content for the event or organization.
• No Review by TeamDayQR: We do not claim ownership of uploads and do not actively monitor content, except for security or legal compliance.

5. Prohibited Use

You agree not to use the Services to:

• Upload or share unlawful, harmful, or infringing content.
• Interfere with or disrupt the security or integrity of Services.
• Attempt to access accounts or data not belonging to you.
• Use QR codes for unauthorized purposes beyond the intended event or organizational use.

6. Data Security and Privacy

• Storage: Metadata may be retained for up to 12 months unless required longer by law or organizer request.
• Cloud Routing: Uploaded files are stored in the organizer’s linked cloud account. We do not permanently store them.
• Security: Industry-standard safeguards (TLS, encryption, access controls) are used. No system is 100% secure.
• Privacy Policy: Use of Services is also governed by our Privacy Policy.

7. International Use

If you access the Services from outside Canada, the US, or the EU, you are responsible for compliance with local laws. Data may be transferred to and processed in the United States via AWS.

8. Fees and Payment

Certain features may be offered for a fee. Fees will be disclosed prior to purchase. All payments are non-refundable unless required by law.

9. Termination

We may suspend or terminate your access if you violate these Terms, misuse the Services, or create legal/security risks.

10. Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee error-free, uninterrupted, or completely secure Services.

11. Limitation of Liability

To the fullest extent permitted by law, TeamDayQR shall not be liable for indirect, incidental, special, or consequential damages, or loss of data, profits, or reputation. Our total liability shall not exceed fees paid by the Organizer in the 12 months prior to the claim.

12. Indemnification

You agree to indemnify and hold harmless TeamDayQR, its affiliates, and employees from claims, damages, or expenses arising from your use of Services, your content, or your violation of these Terms.

13. Governing Law and Jurisdiction

These Terms and disputes relating to them or your use of TeamDayQR are governed by the laws of Ontario and Canada, without regard to conflict of law principles. Ontario courts shall have exclusive jurisdiction. Notwithstanding the foregoing, we may seek equitable relief in any competent court to protect intellectual property or confidential information.

14. Changes to the Terms

We may update these Terms from time to time. Updated versions will be posted with a revised “Last Updated” date. Continued use indicates acceptance.

16. Data Deletion

You may request permanent deletion of your TeamDayQR account and all associated data at any time. Deletion requests can be made through the designated Data Deletion Path provided in your account settings or by contacting us at info@teamdayqr.com. Once your request is verified, we will permanently erase your account information and related data, except where retention is required to comply with legal obligations, resolve disputes, enforce our agreements, or meet regulatory requirements. Uploaded photos and files are stored in the Organizer's linked cloud storage and are subject to the Organizer's data retention and deletion policies.
